Volunteers help clarify important legal issues, refer people to legal services, and answer other questions about the legal process. Volunteers do not provide legal advice or representation, and you do not need expertise in a specific area of law to participate. Legal resource files containing transfers in 15 jurisdictions are provided. People are served on a first-come, first-served basis. Legal Name Change Florida

Employers should pay attention to other laws that may also dictate what counts as part-time. However, a common warning is that too many part-time workers can hurt productivity. Basically, the less time people spend on their work and company culture, the less productive they are. In California, an employer may classify an employee who works at least 32 hours per week as a full-time employee. However, some employers classify all employees who work less than 40 hours per week as part-time. The employer has discretion in this matter in California. Florida follows federal law when classifying full-time employees for overtime pay. This means that an employee must receive overtime pay (usually 150% of base wage) for each hour worked in excess of 40 hours in a single week. No matter what you`ve been told, you can`t give up your minimum wage entitlement, even if you only work part-time.

In this article, our California compensation and hours lawyers explain what you need to know about part-time work in California. Reading this, one of the first things you might ask yourself is: What counts as part-time in California? Today, we are trying to clarify these and other issues. There is no limit to the total number of hours an employee can work in Florida. Employers who pay their employees by the hour must comply with the relevant laws. For example, under federal law, an employer who offers short breaks (less than 30 minutes) must continue to pay that employee. Longer meal breaks (generally defined as 30 minutes or more) do not have to be paid. However, neither federal nor Florida law requires employers to grant breaks, but most employers do so out of habit. Part-time workers often do not have access to the same health and pension benefits as full-time workers. They are entitled to a minimum wage and meal and rest intervals commensurate with the length of their shift. Before hiring part-time workers, it`s important for business owners to consider creating a policy that outlines how many hours an employee would regularly work as a part-time employee at their company.

Public sector employees must work at least 40 hours per week to be considered full-time employees in Texas. There are no such legal requirements for part-time employees. Part-time employees in the public sector must be paid at the same rate as full-time employees in the same categorical activity permitted by the General State Allocation Act. You should also be aware that some businesses abuse the rules for independent contractors in order to avoid proper laws and regulations. Contractors need to have more freedom to set their own hours, direct their own work, subcontract work, and even work for multiple clients at the same time. If your employer restricts any of these activities, you may be classified as a legally mandated employee. Legal employment is beyond the scope of this article, and you should speak to an employment lawyer if you think your employer has misclassified you to avoid regulation. Part-time jobs have traditionally been the retail, fast food, and hospitality sectors, as they require flexible hours to meet fluctuating demand. However, more and more professionals are working more and more part-time to give more freedom to the individual and the company. Employees who consistently work a fixed number of hours per week, e.g. 37.5 or 40 hours is considered full-time by most organizations in Texas. Employees who work less than this number of hours per week are classified as part-time employees.

Under state law, an employer at a retail store cannot force an employee to work seven consecutive days and cannot deny an employee at least 24 consecutive hours of vacation to rest or pray in seven days. The leave must be taken in addition to the usual breaks during the working day. If you work 20 hours or less per week, most laws classify you as part-time and your employer is not required by law to provide benefits under federal or state law. If you work overtime, you are eligible for health insurance under Florida law. Federal and Texas state regulations allow companies to have one benefit package for part-time employees and another for full-time employees, as long as they offer equal employment opportunities. Some benefits are subject to specific restrictions that employers must respect. For example, under federal law, any company that provides pension benefits must offer any employee who works at least 1,000 hours in 12 months the opportunity to join a pension or pension plan. Note that the Affordable Care Act (ACA) does not require employers to offer health insurance. If you`re part-time, it doesn`t mean you can`t get paid for your overtime. Contrary to popular belief, employers often ask “part-time employees” to work more than 40 hours. How many hours is part-time in Texas? Texas private companies have the freedom to define full-time and part-time work at their discretion under federal and state labor codes. You can also set a specific work schedule for yourself. If you have reason to believe that you are eligible for benefits because of the hours you work for your employer, you must first contact your human resources department. Be sure to provide them with records of the hours you worked and ask them if this qualifies you for benefits. If their response isn`t satisfactory, it`s time to talk to a labour lawyer to see if the law offers relief. If a full-time employee is not available during the busiest season of the year, or if other circumstances change, a part-time employee may be forced to work overtime.

If a part-time employee works full-time but does not receive full-time benefits, IRS and ERISA regulations may be violated. You should have a policy that specifies when a part-time employee becomes a full-time employee so that benefits are consistent across your company. While most businesses define full-time employment as between 32 and 40 hours per week, the Affordable Care Act requires a part-time employee to work less than 30 hours per week. A 32-hour week is considered full-time under the Affordable Care Act. Employers usually decide whether employees work full-time or part-time each week. According to the U.S. Department of Labor, the Fair Labor Standards Act (FLSA) does not define full-time or part-time work. On the other hand, the IRS considers a full-time person if they work 30 hours or more per week or 130 hours or more per month. When paying overtime, employers must respond to an employee`s request for unpaid overtime within 15 days. If your employer rejects your request or does not respond for fifteen days, employees are entitled to claim up to two years of unpaid overtime (three years if there is evidence that the deduction was intentional) plus liquidated damages equal to the full amount of overtime pay.

This means that employees who file a successful lawsuit can receive double their total salary in damages. To be successful, you need to keep detailed records of hours worked and hire a lawyer to complete the process. If you are successful, you will receive double your salary, as well as your legal and legal fees. That said, there`s really no California law that takes a hard line on full-time employment. The California Labor Market Review refers to 35 hours or less than part-time, but again, this is more of a guide than a rule. The short answer announces your bottom line and the legal rules and key facts that support it. 13) The main section of the discussion initiates or initiates your first section of in-depth legal analysis; For example, the most important facts and topics are reformulated and the general legal rule is introduced. In an open legal note, you will be tasked with researching relevant primary and secondary resources, such as national, individual or multiple government agencies and assessment circles, to include in your analysis.

Use the legal memo room wisely. Keep in mind that the length of the legal note varies depending on the topic. Some topics require only a brief summary, while others require lengthy treatment. To find your way around, search your office`s document management system for previous legal notes. The legal note shows your critical legal thinking skills. Use your research plan and materials to organize your analysis. Remember to clearly articulate the law and facts in an active voice and present your analysis in a logical way. You may not know which facts are legally most important when you start writing the memo. Your thinking may become clearer and better organized as you write. You would determine which facts are legally significant by referring to the actual criteria (based on elements or factors) of the legal authority relevant to the matter – for example, laws or case law.

Legal Meaning of Squatting

While there was a time and place for these particular laws, this law remains in effect. The idea of moving to an undeveloped lot or an empty house and making it your own still exists, which means laws still protect squatters. For example, your neighbor accidentally builds a fence around part of your land, but you don`t mind because you`re not sure about the actual boundaries. Later, after a country-specific period, your neighbor can become a law-abiding tenant and legally take possession of what could have been part of your land. However, since the man had been living there for more than 30 days, he had introduced the law of squatters. Throwing him out of the apartment was an illegal eviction. When the squatter went to the New York Housing Court, the judge granted him permission to enter the property a few days later. There have been a number of similar conflicts between the slums, some of which are related to the Western Cape anti-eviction campaign, and Cape Town City Council. One of the most famous cases was the eviction of squatters from N2 Gateway houses on the outskirts of Delft, where more than 20 residents were shot, including a three-year-old child.

There have been many complaints about the legality of the government`s actions. [11] Many families then squatted on Symphony Way, a main street in the municipality of Delft, before being forced to move to a camp called Blikkiesdorp. [12] However, intruders can eventually become squatters if they occupy the property long enough. If the trespass becomes a squat, the squatter may have the right to assert a property claim and make your property their permanent residence. Squatter rights or harmful property are a set of laws that were developed when colonization was popular. The government drafted the Homestead Act of 1862, which established the right to provide legal assistance to pioneers who moved to land they considered empty, built a house, and began raising livestock or growing crops. This was a way for pioneers to expand the amount of land under the U.S. government at the time. Israeli settlements are communities of Israeli citizens living in the Palestinian territories. The international community considers settlements in the occupied territories to be illegal. [13] [14] In March 2018, Israeli settlers were evicted from a house they illegally occupied in Hebron, a Palestinian city in the West Bank. The fifteen families had argued that they had bought the house, but the Supreme Court ruled that they had to leave. Israeli forces declared the building a closed military zone and it was not clear whether the Palestinian owners could be recaptured. The settlers already occupied the house and were evicted in 2012. [15] In October 2018, Fatou Bensouda, chief prosecutor of the International Criminal Court, said Israel`s planned destruction of the Bedouin village of Khan al-Ahmar could constitute a war crime. [16] The majority of squats are residential in nature. Squatting tends to occur when a poor and homeless population sees dilapidated properties or land.

[1] According to author Robert Neuwirth, there were more than 1 billion (one in seven) squatters in the world in 2004. If current trends continue, this share will increase to 2 billion (one in four) by 2030 and 3 billion (one in three) by 2050. [2] Despite the number of squats, according to academic Kesia Reeve, “squatting is largely absent from political and academic debate and is rarely conceptualized as a problem, as a symptom or as a social or housing movement.” [3] In many poor countries of the world, there are vast slums, usually built on the outskirts of major cities, consisting almost entirely of self-built housing built without the owner`s permission. [4] Although over time these settlements are both legalized and indistinguishable from normal neighborhoods, they often begin as squatted homes with minimal basic infrastructure. So there are no sewers, drinking water has to be purchased from vendors or transported from a nearby tap, and if there is electricity, it is stolen from a passing cable. Such colonies also exist in industrialized countries, such as Cañada Real on the outskirts of Madrid. The relationship between a squatter and the owners is not the same as between an owner/owner and a tenant. Renting a house or apartment always requires documents, such as a basic lease, that will help resolve a dispute between landlords and tenants. Squatters act independently and may claim to have legal documents that “confirm” their legal occupation of a particular place or country, but these documents certainly do not guarantee that law enforcement is on their side.

In Geneva, Switzerland, 160 buildings were illegally occupied and more than 2,000 squatters were used in the mid-1990s. It was located in two buildings on the Boulevard des Philosophes, a few blocks from the main campus of the University of Geneva. Case management simply involves the effective coordination, organization and delivery of all these basic components for legal matters. This may mean that junior members of the legal team are working in a technical bubble. Your work may be legally correct and persuasive, but it doesn`t advance the client`s story.

I`m sure you`ll have noticed the reference to “emotional connection.” In some areas of law, such as crime and family, emotions are often close to the surface, but dig a little deeper and they are also present in commercial legal work. For example, it should be easy to make an emotional connection between the late completion of a much-needed new hospital and the negative impact on people`s lives. Many lawyers and legal service providers are now familiar with the concept of case management. How can we provide more meaningful legal services for clients? Tracking expenditures against budget is a key element in all cases where outside counsel or other legal service providers are hired. It is always important to monitor the performance of expenditures against budget, track work-in-progress and provisions, and look for issues that could negatively impact the budget and expenses. As the name suggests, business management is the process of managing a legal case (with or without technology). But what does that mean? To explain it, it is easier to first examine the constituent elements of a legal matter. Although case management has received more attention with the growth of legal tools aimed at streamlining the process, it is important to note that case management is a discipline that has been around much longer than any software tool. Recently, efforts have been made in the area of legal services to raise awareness among the “end-user” of these services. I don`t think the tools or approaches used matter – agile, user-centric design or project templates that stimulate the client`s narrative – as long as at the end of the day, the advice given to the client makes sense to them and advances the story of their problem and how they have dealt with it. While legal teams are smart people, it`s only natural that they can`t have all the answers. You need quick access to accurate, high-quality data and expertise to take care of the delivery of all legal matters.

Making this knowledge available when needed is an essential part of material management. Storytelling helps lawyers recount what happened and use the facts and the law to make an emotional connection to the legal issue that convinces the decision-maker or the public to find in favor of the client. The real purpose of the client`s Q&A session is to help the client explain their story and understand the legal team. Filling out detailed templates in a specific order means that students follow a proven process to get it right. These starting points are intended to serve as an invitation for lawyers and legal project managers to identify, discuss and define the facts with their clients. When people think of material management, they usually think of it at the material (micro) level, for example the management of a single material. This will normally be the case for participants in certain questions who need an overview of the activity of the issue and who have access to documents and know-how related to the material. However, legal services are constantly dealing with a large number of ongoing issues that also need to be managed and tracked at the portfolio (macro) level. This is especially true for general counsel, OCOL and legal operations managers who need transparency, reporting and knowledge on all legal matters.

Therefore, it is important to remember that materials management also includes material portfolio management. While many legal issues are complex and have their own nuances, most legal issues are quite stereotypical. In other words, they follow a defined sequence of phases and stages, depending on the facts and circumstances of the case. The Subject Matter Definition workshop is only one part, albeit an important one, of my three-day training in legal project management. CORPORATE AND INCOME TAX LAW (BUKOTAX) 3 units The course is primarily a study of the basic principles of taxation, income tax, inheritance and gift tax, as well as the various corporate taxes and transfer taxes levied under the National Tax Code (NIRC). As directors and managers of the legal industry, we need to ensure that we are aware of current trends in the legal industry and learn how external factors affect us and our law firms. By learning the importance of keeping abreast of legal trends and using them in our firm`s strategic plans, we can develop strategies to improve our firm`s performance and make them “dynamic law firms.” COMPUTER APPLICATION FOR LEGAL MANAGEMENT 1 (COMP1LM) 3 teaching units The course is taught through a combination of lectures and computer lab teaching. Its ultimate goal is to develop students into leaders and managers of the twenty-first century, equipped with knowledge of management principles and business laws for good governance and listening to the globalized business environment. The courses in the programme are designed to provide students with appropriate knowledge of business laws and principles, and to enable them to develop ethical and legally sound business solutions or strategies in service of the local and global community. The American Bar Association`s accreditation standards require students to regularly take the courses in which they are enrolled. Lewis & Clark expects students to attend classes regularly and prepare diligently for classes.

Legal Literacy

Legal awareness is an important part of working life. [36] According to John Akula, when legally sensitive issues arise, business leaders often find themselves in an uncharted field, often without the necessary legal training. [37] When business leaders work with lawyers, they need to develop a common language to address likely communication gaps and develop a strong sense of law. [38] Without (legal) literacy, people can be intimidated and alienated from the law. But without legal competence, the concept of the rule of law does not offer the protection it should offer when people unknowingly renounce their rights. In addition to external counsel, in-house counsel[39] and in some countries such as Australia and India, the Corporate Secretary is responsible for advising on good governance practices and compliance with corporate governance standards, as required by various corporate, securities and other corporate laws, regulations and policies. [40] [41] According to Hasl-Kelchner, corporate legal literacy addresses the legal risk profiles of businesses, both at the employee and organizational levels. In “legal competence”, the semantic components are the predominant notion of “law”, “law”, “responsibility to the law” and “civic literacy” plus the terms “civil society”, “individual rights and freedoms” and “human responsibility to civil society”. [44] Applied legal education is provided by the business school and some other branches. The news media also play a role, but are not able to meet all socio-legal literacy needs. [ref. needed] NGOs and legal aid centres may provide limited legal expertise in certain priority areas.

[25] Public legal education, sometimes referred to as civic education, includes a range of activities aimed at building public awareness and skills related to law and justice. This term also refers to the areas of practice and study that deal with these activities and to a social and professional movement that advocates for greater societal commitment to educating people about the law. Anna-Marie Marshall explains: “To realize their rights, people must take the initiative to express them. This initiative, in turn, depends on the availability and relevance of the legal regime for people facing problems. [4] Indeed, laws exist as part of a larger organizational ecosystem in which the interests of the organization as well as those of the actors are inextricably linked to how they are implemented. “Today, you can`t access basic legal information if you don`t have internet, computers or basic digital skills. The Legal Literacy Initiative is the link that allows residents to access information, answer questions themselves, and determine if and how they want legal help. According to Lorenzo Cotula, laws are usually published in the Official Gazette and few people outside the legal community have access to legal information. [28] Illiteracy,[28] economic barriers,[29] language barriers, social taboos,[30] and lawyers` lack of zeal can lead to barriers to obtaining the necessary basic legal training. According to Hanna Hasl-Kelchner, lawyers sometimes tend to say no and kill an agreement instead of solving problems and finding solutions that are both practical and legally sound. [31] With few changes in the definition of the Multiple Actions Research Group (MARG, an NGO working to promote legal awareness), legal awareness can be defined as “critical knowledge of legal regulations and processes, coupled with the ability to use this knowledge to respect and realize rights and prerogatives.” [1] [12] The objectives of legal jurisdiction are a public matter: my subject today is “legal jurisdiction”, but to put it that way, immediate clarification is needed, because this expression has a wide range of possible meanings with which we will have much to do with it.

While their communication duties generally remain the same, the specific responsibilities of liaison officers vary from employer to employer. In terms of experience and education, potential liaison officers should have an associate`s degree or a post-secondary bachelor`s degree, often in business, criminal justice, international relations, management or political science, depending on the organization`s field of activity. Additional training may also be required.

For example, liaison officers working in departments of public safety may need to meet mandatory training requirements for that department. Liaison officers are contact persons in companies during major events such as emergencies or changes in management, such as the appointment of a new CEO. Reporting and analysis of events is part of the duties of liaison officers. This includes reporting on incidents, events or updates to learn from them and improve future processes and relationships. In the context of business and infosec, the liaison officer is responsible for coordinating inter-agency responses to a breach, hack or attack. The need for this role is clear: in the event of a serious breach, incident or other emergency, multiple resources and agencies must be deployed to respond effectively to incidents – an effort that requires timely and effective coordination. Since their primary task is to coordinate activities and communication between individuals, agencies and organizations, successful liaison officers must possess strong organizational skills. They prepare oral communications such as press conferences, interviews, telephone calls and face-to-face meetings, as well as written communications, including news releases, reports and social media updates, to colleagues, employees, the public and other stakeholders.
